By accessing or using our website at purestones.art (the “Website”) or placing an order with us, you agree to be bound by these Terms of Service (“Terms”).

1. GENERAL CONDITIONS

1.1 You must be 18 years or older (or have parental/guardian consent) to place an order.
1.2 We reserve the right to refuse service, limit or cancel orders in our sole discretion — including for suspected fraud, misuse, or circumstances beyond our control.
1.3 We may modify these Terms at any time; the most current version will be posted on the Website. Your continued use indicates acceptance.

2. FORMATION OF CONTRACT

2.1 When you place an order, you are making an offer to purchase the selected products.
2.2 We may accept or reject your offer at our discretion (for reasons including product availability, fraud risk, or incorrect information).
2.3 A legally binding contract is formed only when we send you an order confirmation email.
2.4 Until you receive confirmation, you do not have a contract for purchase.

3. PRODUCTS & NATURAL VARIATIONS

3.1 Our products are made from natural stones and materials. Slight variations in colour, pattern, shape, or clarity are inherent to natural crystals and are not defects.
3.2 We aim for accuracy in descriptions and images, but do not guarantee perfection.
3.3 We reserve the right to discontinue any product or collection at any time, and to modify pricing or availability without notice.

4. PRICING & PAYMENT

4.1 All prices are listed in EUR, unless stated otherwise.
4.2 Payment is required at time of order via our approved payment processors (Stripe, PayPal, Shopify Payments, etc.). We do not store full card details.
4.3 We reserve the right to cancel orders if payment fails, or if fraud or suspicious activity is detected.

5. SHIPPING, DELIVERY & RISK TRANSFER

5.1 We ship domestically and internationally. Delivery times are estimates and not guaranteed.
5.2 Risk of loss or damage transfers to you once the parcel is handed to the carrier.
5.3 International shipments may incur customs duties, taxes, or import fees — you are responsible for these costs.
5.4 We are not liable for delays caused by customs, carriers, weather conditions, or other external factors.

6. RETURNS & REFUNDS

6.1 If eligible, returns must be initiated within 14 days from delivery and items must be unused, in original condition and packaging.
6.2 Return shipping cost is your responsibility unless the item is damaged or incorrect.
6.3 Refunds will be processed to the original payment method once items are received and inspected.
6.4 Gift cards, sale/final-sale items, and customised products may be non-returnable.

7. HEALTH & ENERGY DISCLAIMER

7.1 Our crystals, bracelets, and energy tools are complementary wellness products and are not medical devices.
7.2 They are not intended to diagnose, treat, cure, or prevent any disease.
7.3 Always seek advice from a qualified healthcare professional for medical concerns.
7.4 Individual outcomes will vary; we do not guarantee results.

8. ACCOUNTS & SECURITY

8.1 When you create an account, you agree to provide accurate and complete information and to keep your credentials secure.
8.2 You are responsible for all activities under your account.
8.3 We are not liable for losses due to unauthorized use of your account when caused by your failure to keep login details secure.

9. THIRD-PARTY TOOLS & INTEGRATIONS

9.1 The Website may integrate third-party services such as analytics, payment gateways, and marketing platforms.
9.2 We do not control these third parties and are not liable for their functionality, content, or compliance.
9.3 Your use of such tools is at your own risk and subject to the applicable third-party terms.

10.1 If you post reviews, comments, photos, or other content, you grant us a non‐exclusive, royalty‐free, worldwide, perpetual license to use, reproduce, modify, publish, display, and distribute that content for our business purposes.
10.2 You must ensure you have all rights to the content you provide.
10.3 We may remove or edit any user content at our discretion.

11. INTELLECTUAL PROPERTY

11.1 All content on the Website — including product images, text, designs, logos, and trademarks — is owned by Purestones.art or its licensors.

18. ENTIRE AGREEMENT

These Terms constitute the entire agreement between you and us regarding your use of the Website and supersede all prior agreements or understandings.
